Welcome to LearningBytes! These terms of service (“Terms”) govern your access to and use of our progress tracking assessment application (“LearningBytes”) and any related services we provide. By accessing or using our application, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must not use our application.

Acceptance of Terms

By creating an account or using our application, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or policies that may be posted in the application.

Account Registration

To access certain features of our application, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. You must notify us immediately of any unauthorized use of your account. 

User Responsibilities 

You agree to use the application only for lawful purposes and in accordance with these Terms. You must not

• Use the application in any way that violates any applicable federal, state, local, or international law or regulation.
• Impersonate or attempt to impersonate LearningBytes, a LearningBytes employee, another user, or any other person or entity. 
• Upload, transmit, or distribute any unlawful, harmful, defamatory, obscene, or otherwise objectionable material.
• Use the application to collect or harvest personal information from other users without their consent.

Intellectual Property Rights

All content, features, and functionality in the application, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of LearningBytes or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content from the application without any express written permission.

Data Collection and Use

By using the application, you acknowledge and agree that we may collect, use, and share your information in accordance with our Privacy Policy. You are responsible for ensuring that any data you enter into the application is accurate and complies with applicable laws and regulations.

Termination

We reserve the right to suspend or terminate your access to the application at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the application. You may terminate your account at any time by following the instructions in the application.

Disclaimers

The application is provided on an “as-is” and “as-available” basis. LearningBytes makes no representations or warranties of any kind, express or implied, regarding the operation of the application, the accuracy of the information provided, or the results obtained from using the application. To the fullest permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

In no event shall LearningByte, its affiliates, or their respective directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the application, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from or related to these Terms or your use of the application shall not exceed the amount paid, if any, for accessing the application in the twelve (12) months preceding the claim. 

Indemnification

You agree to indemnify, defend, and hold harmless LearningBytes and its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the application, your violation of these Terms, or your infringement of any third-party rights.

Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the effective date at the top. Your continued use of the application after any modifications to the Terms will constitute your acknowledgment of the modifications and your consent to abide by and be bound by the modified Terms. 

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms shall be resolved exclusively in the courts located in the United Arab Emirates.
